Terms and Conditions

These terms and conditions govern all transactions through and the use of the Burnsco website and your dealings with Burnsco (Ts and Cs).  By accessing and using this website, or undertaking any transaction or dealing with Burnsco. you agree to be bound by these Ts and Cs and any variation of them as updated on this website from time to time.

Burnsco means Hauraki Marine Limited, trading as Burnsco.  

Apart from normal transactions to buy products, you may make use of this website for personal use, non-commercial use or research only, provided that any reproduction includes a prominent acknowledgement of Burnsco’s rights in the relevant content.  You may not use this website or the content on it for any other purpose or in any other way. 

An order made via this website is an offer to purchase one or more products.  When you place your order, Burnsco will email you an acknowledgement.   If there are any issues with your order, we will try to contact you.

Neither acknowledgement of your order nor acceptance by Burnsco of payment for your order constitutes acceptance of your order.  Burnsco’s acceptance of an order does not take place until the order is dispatched to you.  

Where possible your order will be sent in one consignment.  However, Burnsco may send your order in multiple shipments.

The risk of any loss of, or damage to, any product will pass to you on delivery. 

Burnsco may, in its entire and unfettered discretion, refuse an order.  Refusal may, for example, be due to: 

• the product ordered being unavailable, or
• fraudulent activity flags being activated (whether your transaction is fraudulent or not), or
• the identification of an error within the product information, including price or promotion.

Please note that stock levels (whether shown on the website or given by our Customer Services team on the phone or by email) are indicative only.

We use reasonable endeavours to ensure that each product complies, in all material respects, with its product description appearing on this website at the time when you submit the order. If a product does not comply with its product description, you may return the product(s) and accept a refund or exchange the product(s). See the Returns page for more information. 

Burnsco has used reasonable endeavours to provide current, accurate and complete content on this website.  However Burnsco does not guarantee the content will be current, accurate or complete when you access it.  Burnsco provides the content on, or accessed through, this  website, on an “as is” basis.  You must make your own assessment of the suitability of the content and/or products for your own purposes. You are solely responsible for the actions you take in reliance on the content on or accessed through this website.   Users seeking to rely on or verify any content or products contained on this website should contact their nearest Burnsco store.  Burnsco may change the content or products on this website at any time without notice.

The names “Burnsco”, “Burnsco Marine” and “Burnsco Marine and Leisure” and associated logos are the property of the Macleod Family Trust.  The names “Tasman”, “Wipeout” and "Edge" and associated logos are the property of Hauraki Marine Limited.  All other product, service and brand names and logos on this website are trademarks of the companies who own them.  

All other content on this website is owned by Burnsco (or the relevant content supplier).  Burnsco is the exclusive owner of all rights in the compilation, design and layout of this website.

This site may contain third party content and links to third party websites which have not been created by and/or are not controlled by Burnsco.  These links are provided for your convenience only, and do not imply that Burnsco checks, endorses, approves or agrees with third party content on this website or the third-party websites it links to from time to time.  If you wish to link your website to any part of this website, you must get Burnsco’s prior written consent.
